In December 2009, Aurora World, Inc. sued Ty Inc. in a California federal court claiming that Ty's Beanie Boos were "unlawful imitations" of Aurora'sYooHoo & Friends.[1] As a result of the initial hearing, Ty agreed to pull images of "Bubblegum" and "Cleo" Beanie Boos from all displays and point of purchase materials in the United States. The fate of the remaining Beanie Boos will be determined when the copyright case goes to trial.[2]
There are three types of Boos in the current Ty Beanie Boo family. The Original 7 Beanie Boos sold exclusively in the UK in June 2009. Slightly modified versions of six of the original seven Boos were released in the UK and USA later in 2009. In August 2009, the second release of Boos arrived in the UK. Peanut had disappeared and the original Bubblegum was renamed Kooky. A new Lemur appeared with the name Bubblegum, accompanied by a new Bush Baby named Cleo. The second UK release of Boos also had several color, size and fur texture changes from the 1st release.Beanie Boos shipped to USA dealers for the first time in November 2009. Two Boos were omitted from USA shipments; Bubblegum and Cleo. Ty, Inc. had removed Bubblegum and Cleo from the US market in response to a copyright infringement lawsuit filed by Aurora World, Inc.
Another Boo size comparisonIn late 2010, Buddy-sized Boos appeared with swing tags that did not identify them specifically as Buddies. For that reason (on our individual Boo pages), we call these new Buddy-sized Boos "Large" Boos instead of Boo Buddies. These new large Boos have a Buddy-style tush tag that says "The Beanie Boo Collection®"
